The investor selects an EB-5 project and retains an attorney.
The investor prepares the documents for escrow bank to review with assistance from the attorney/agent.
Upon the approval from the escrow bank, the investor wires the money into the escrow account.
The attorney files I-526 on behalf of the investor.
If the USCIS approves the I-526 petition, the investment amount plus the administrative fees will be released from the escrow.
The investor and his/her family members* can then go through the consulate process in Guangzhou to obtain visa to enter the US; if the investor is in US, he/she can file to adjust his/her status.
If the I-526 petition is denied, the investor gets full refund on both the investment amount and the administrative fees.
The attorney files I-829 on behalf of the investor to prove the investment amount has created 10 qualified jobs, thus removing conditions on the green card.
If the USCIS approves the I-829, the investor and his/her family members become permanent resident of the US.
If the USCIS denies the I-829, the investor needs to find other ways to seek permanent residence in the US.
*Family members are spouse and unmarried children under age 21.
